9845 Legal problems with sale
I have found a very willing purchaser for my property in Italy but we are having legal problems. We both live in the UK, wish to complete the purchase in £ sterling paid in the UK. However, we have two problems with the contract as drawn up by our Italian solicitor based in the UK. 1. We have been asked to indemnify the purchaser against 'latent defects'. The property was an 800 year old wreck when we bought it and we received no such indemnity. We have restored it but a caveat like this is impossible to comply with. Also we have heard that this clause has in fact been taken advantage of. We have no reason to suppose our purchaser has even asked for this clause but apparently it is part of the civil code. Any ideas please? 2. We understand that the only way to complete the purchase is in Italy in front of the notaio with a banker's draft. We would not know what a banker's draft looks like and both we and presumably our purchaser would be in the position of wandering around the country and on a plane back to England with a sum of money which is virtually in cash. Has anybody encountered this situation - I cannot believe that potentially enormous sums of money are taken across the world like this. We do not wish to disadvantage our lovely purchaser in any way but these conditions are nearly impossible to comply with.
